Summary

LACNIC's current policies only consider the distribution of resources to “legally constituted organizations.” However, the term “legally constituted” has not been defined, so in various jurisdictions this might be interpreted as legal incorporation, meaning that only legal entities are “legally constituted organizations.”

On the other hand, LACNIC interprets this term as applying to “both legal entities and individuals registered under a national framework for self-employed workers (for example, sole traders, self-employed individuals, etc.).”

This interpretation should be resolved in a manner that leaves no room for subjectivity while providing the broadest possible legal coverage.

Rationale (Describe the problem you intend to solve)

Individuals engaged in regulated economic activity in any of the countries within LACNIC's service region should be able to receive resources, provided they meet existing policy requirements.

It would be paradoxical if, for example, national legislation allows an individual to operate a data center, yet they cannot do so because LACNIC's policies—if interpreted literally—prevent them from receiving resources as independent entrepreneurs, unlike the policies of the other RIRs.

The current wording of the Policy Manual needs to be revised to avoid misinterpretations, whether by those reading the manual for the first time or in the event of changes in interpretation by the staff.

The proposed change does not alter LACNIC's current operations but rather reflects how policies are applied in practice.
